By downloading, installing, copying or running the Software you accept the terms below. If you do not accept them, you must not use the Software and must delete all copies.
1 SUBJECT MATTER AND DEFINITIONS
(1) "Software" means the tool named above with all of its components, in particular source code (Lua, Python, JavaScript, HTML, CSS), compiled or encrypted versions thereof, configuration and data files, graphics, icons, sounds, the design and layout of the user interface (WebUI), the colour and design scheme, documentation, sample files and all updates.
(2) "User" means any natural or legal person who downloads, installs, runs, copies or distributes the Software.
(3) The Software is licensed, not sold. The User acquires no ownership, only the rights of use described in section 2.
2 RIGHTS GRANTED
(1) The author grants a non-exclusive, non-transferable, non-sublicensable and revocable right to install and use the Software on any number of devices owned or controlled by the User.
(2) Use is limited to private, non-commercial flight simulation (X-Plane).
(3) The User may make backup copies for personal use.
(4) Modifying the Software for the User's own private use is permitted; distributing modified versions is not (section 3). Mandatory statutory rights, in particular sections 69d and 69e of the German Copyright Act, remain unaffected.
(5) Any other use requires the author's prior consent in text form (email is sufficient).
3 RESTRICTIONS
Without prior consent in text form, the User must not:
a) DISTRIBUTION - — copy, distribute, upload, mirror or offer the Software or parts of it, in particular via download portals, add-on sites, file sharing services, cloud folders, messenger or Discord servers, torrents, "modpacks", compilations or preconfigured simulator installations. Only a link to the official source may be shared.
b) COMMERCIAL EXPLOITATION - — sell, rent, lease, lend, sublicense, use as a bonus or part of a paid offering, or place behind a paywall.
c) DERIVATIVE WORKS - — publish or pass on modifications, translations, extensions, ports to other simulators or aircraft, or other derivative works.
d) REUSE OF COMPONENTS - — reuse source code, functional flows, algorithms, data structures, interface definitions, user interface design, structure and layout, colour and design scheme, graphics, icons, sounds or texts in other products, including in altered or rewritten form.
e) NOTICES - — remove, alter or obscure copyright, trademark, licence or version notices, including source file headers, the "Isar Simworks" mark and logo, version and build identifiers, and notices in the user interface.
f) REBRANDING - — publish the Software under a different name or brand, or present it as the User's own work.
g) ARTIFICIAL INTELLIGENCE - — use the Software, its source code, design or documentation as training, fine-tuning or evaluation data for artificial intelligence or machine learning systems, or include it in datasets for such purposes. A reservation of rights for text and data mining under section 44b(3) of the German Copyright Act and Article 4(3) of Directive (EU) 2019/790 is hereby expressly declared in machine-readable form.
h) COMMERCIAL USE - — use the Software in commercial training or simulator operations or otherwise for business purposes. Showing the Software in videos, streams, reviews and tutorials remains expressly permitted, even if monetised, as long as the Software itself is not offered for download or resale.
i) CIRCUMVENTION - — circumvent, remove or disable technical protection, licence, verification or update mechanisms.
j) REVERSE ENGINEERING - — decrypt, decompile or reverse engineer encrypted or compiled components, except where permitted by mandatory law.
4 RESERVATION OF RIGHTS
All rights not expressly granted remain with the author. Under German law copyright itself is not transferable; only rights of use as set out in section 2 are granted. Providing the Software free of charge does not constitute a waiver of any right.
5 TRADEMARKS AND INDEPENDENCE
(1) "Isar Simworks" and its logo are marks of the author and must not be used for other offerings, republications, or in any way suggesting a connection with or endorsement by the author. Nominative reference remains permitted.
(2) X-Plane and Laminar Research, ToLiss, Hoppie ACARS, SkunkCrafts Updater and all other names and marks mentioned belong to their respective owners. The Software is an independent product; there is no affiliation with, cooperation with, or endorsement by these parties.
6 THIRD-PARTY COMPONENTS
Where the Software includes third-party libraries, fonts, graphics or data, the licences listed in THIRD-PARTY-NOTICES.txt take precedence for those components. This licence does not restrict the rights granted there.
7 NETWORK CONNECTIONS AND DATA
(1) The Software may run a local web server on the User's machine or home network and connect to third-party services (e.g. datalink or weather services). The User is responsible for operating and securing their own network.
(2) Third-party services are governed solely by their own terms and privacy policies. Details of data processing are set out in the documentation.
8 WARRANTY
The Software is provided free of charge and "as is". No particular quality, freedom from defects, availability, continued development or fitness for a particular purpose is promised, and no compatibility with future versions of X-Plane, XPPython3, FlyWithLua, aircraft add-ons, operating systems or other software is assured. For defects the author is liable only in cases of fraudulent intent and gross negligence (sections 521, 523, 524 of the German Civil Code).
9 LIABILITY
(1) The author is liable without limitation for intent and gross negligence, for injury to life, body or health, for fraudulently concealed defects, within the scope of an express guarantee, and under the German Product Liability Act.
(2) For slightly negligent breach of a material contractual obligation, liability is limited to the foreseeable damage typical of this type of contract.
(3) Any further liability is excluded.
(4) The User is responsible for backing up their own data and simulator installation.
(5) The Software is for entertainment and simulation only. It is not intended or approved for real-world aviation, creditable flight training or safety-critical applications.
10 TERM AND TERMINATION The rights granted are perpetual but terminate automatically, without notice, upon any breach of section 3. On termination the User must stop using the Software and delete all copies. Statutory claims of the author for injunctive relief, removal, information, damages and destruction remain unaffected.
11 CHANGES TO THIS LICENCE Future versions of the Software are governed by the licence supplied with them. Rights already granted for versions already obtained remain unaffected.
12 FINAL PROVISIONS German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection rules of the User's country of habitual residence remain unaffected. Place of jurisdiction is Munich, Germany, to the extent legally permissible. If any provision is or becomes invalid, the remaining provisions stay in force. Amendments require text form.
